1. Definitions
In these terms and conditions, the following definitions apply:
- Forever Wedding: the trade name under which the service is offered, operated by Alwend werkt B.V.
- User: any natural or legal person who makes use of the services of Forever Wedding.
- Service: the online platform of Forever Wedding through which guests can upload photos via a QR code at a wedding or event, and the registered user can manage and share those photos.
- Plan: the agreement by which the User gains access to the (extended) features of the Service in exchange for payment.
- Guest: a visitor who uploads photos via the QR code of an event without having an account.
2. Applicability
These terms and conditions apply to all offers, agreements and services of Forever Wedding. By using the Service, the User accepts these terms.
Deviations from these terms are only valid if agreed in writing with Forever Wedding. Guests who upload photos via the QR code are also deemed to have taken note of the provisions about uploading content.
3. Offer and agreement
All offers by Forever Wedding are without obligation and may be withdrawn at any time. An agreement is formed when the User registers and accepts the applicable terms.
Forever Wedding reserves the right to refuse a registration without stating reasons.
4. Plans and pricing
4.1 Plans
Forever Wedding offers the following plans:
- Free: up to 50 photos, the live wall and 7 days of gallery access.
- Basic (personal): unlimited photos, HD uploads, the live wall, the highlight film, the ZIP download and 1 year of gallery access, for a one time payment per wedding.
- Premium (personal): everything in Basic, 3 years of gallery access, a highlight film without length limit and priority support, for a one time payment per wedding.
- Business Starter and Business Pro: multiple events per month (5 on Starter, 15 on Pro), each with its own QR code and live wall, billed monthly or yearly.
The current prices are shown on the pricing page. All prices include VAT.
4.2 Price changes
Forever Wedding reserves the right to change prices. Price changes are communicated at least 30 days in advance. In the event of a price increase, the User has the right to cancel a business subscription before the new price takes effect. Personal plans that have already been paid are not affected.
5. Payment
Payments are processed via the offered payment methods, through Stripe. Personal plans are a one time payment per wedding and do not renew. Business subscriptions are billed in advance for the chosen period.
In the event of late payment, Forever Wedding is entitled to (temporarily) suspend access to the Service.
Business subscriptions renew automatically unless the User cancels before the end of the current period via the customer portal in the subscription settings.
6. Use of the service
6.1 Permitted use
The Service may only be used for lawful purposes and in accordance with these terms. It is prohibited to:
- Upload content that infringes the intellectual property rights of third parties;
- Post unlawful, offensive, discriminatory or sexually explicit content;
- Use the Service for spam or commercial purposes without permission;
- Circumvent or damage the technical security of the Service;
- Upload more than the permitted number of photos per event.
6.2 Guest content
The User is responsible for content uploaded by guests through their event. Forever Wedding accepts photos of up to 10 MB each and does not accept executable files or videos from guests.
7. Intellectual property
Photos uploaded by guests remain the property of the guests who took them. By uploading, the guest grants Forever Wedding a limited licence to store and display the photos and make them available to the User concerned.
Forever Wedding claims no ownership rights over content uploaded by Users or guests. The User warrants that uploading content does not infringe any rights of third parties.
The platform itself, including the software, design and branding of Forever Wedding, is and remains the exclusive property of Alwend werkt B.V.
8. Privacy and data processing
Forever Wedding processes personal data in accordance with applicable laws and regulations, including the General Data Protection Regulation (GDPR). For more information, please read our privacy policy.
9. Liability
9.1 Service obligations on paid plans
Forever Wedding makes every reasonable effort to keep photos available for the gallery access period of each paid plan (Basic: 1 year; Premium: 3 years). These obligations are fulfilled on a best effort basis. Forever Wedding cannot guarantee uninterrupted availability at all times and is not liable for temporary outages.
9.2 Limitation of liability
To the maximum extent permitted by applicable law, the total liability of Forever Wedding to a User for any loss or damage, including loss of photos, is limited to the total amount paid by that User to Forever Wedding for the plan concerned in the twelve months before the event giving rise to the claim.
For Users on the Free plan, Forever Wedding provides the service as it is, without any warranty of availability or data retention, and no liability is accepted for loss of data.
9.3 Exclusion of indirect and consequential damages
Under no circumstances is Forever Wedding liable for:
- Indirect, incidental or consequential losses;
- Loss of sentimental or emotional value (including irreplaceable wedding memories);
- Loss of revenue, business opportunity or reputation;
- Unlawful or inappropriate content posted by guests or third parties;
- Actions by third parties who have gained unauthorised access to the account of a User.
9.4 Force majeure
Forever Wedding is not liable for any failure to fulfil its obligations caused by circumstances beyond its reasonable control, including but not limited to failures by hosting providers, power outages, natural disasters, cyberattacks or changes in applicable law.
We strongly recommend downloading your photos. Even on paid plans, downloading your photos to your own device or cloud storage is the only way to guarantee permanent access. Forever Wedding is a sharing and presentation platform, not a permanent archive.
10. Suspension and termination
Forever Wedding may suspend access to the Service or terminate the agreement if:
- The User violates these terms;
- There is evidence of fraudulent use;
- There are indications of misuse of the Service.
After a plan ends or is terminated, uploaded photos are deleted after 90 days unless the User has downloaded them before then.
11. Amendments
Forever Wedding reserves the right to amend these terms and conditions. Registered Users are notified by email of material changes. Continued use of the Service after the changes take effect constitutes acceptance of the amended terms.
12. Governing law
These terms and conditions and all agreements with Forever Wedding are governed exclusively by Dutch law. Disputes are submitted to the competent court in the district where Alwend werkt B.V. is established.
